Terms and Conditions of Sale

1. Introduction and Scope of Application
These Terms and Conditions of Sale ("Terms") govern the purchase and use of the products and services of The Golf Athlete in Hanoi through thegolfathletex.com and its related pages (together, the "Website").
These Terms apply to every customer who books, or buys any product or service from, The Golf Athlete studio in Hanoi. Our studios in Indonesia are operated by a separate Indonesian company and are not covered by these Terms.
By booking, creating an account or paying, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the service.

3. Definitions and Interpretation
"TGA", "we", "us" means Elevate Performance Joint Stock Company.
"Customer", "you" means the individual who books and uses the service.
"Session" means one one-to-one coaching session with a coach at the studio.
"Pack" means a number of sessions bought in advance and tied to a named coach.
"Membership" means a monthly plan with a fixed number of sessions and a fixed validity period.
"Course" means a training programme with a fixed number of sessions, fixed content and fixed dates, sold as a whole.
"Group class" means a session attended by several customers on a fixed timetable.
"Workshop" means a one-off themed session held on a published date.
"Online coaching package" means a programme delivered remotely through an online platform.
"Performance Screen" means a movement assessment carried out using the TGA method.
"Gear" means the physical products we sell, including training equipment, apparel and anything else listed on the Website.
4. Terms of Use / Eligibility for Service Use
You must be 18 or over to book, pay and sign the training waiver for yourself.
For anyone under 18, including our junior programme, a parent or legal guardian books, pays, signs the waiver and is the responsible party under these Terms.
You agree to give true, accurate and complete information when you book and when you create an account, and you are responsible for keeping your account login details secure.
5. Products and Services
TGA offers: one-to-one sessions; multi-session packs; monthly memberships; courses; online coaching packages; performance screens; group and junior classes; workshops; and training gear.
The price of coaching depends on the coach you choose. The price that applies is the price shown on the Website at the moment you confirm your order, plus VAT as set out in section 7.
We may change our service list, our prices and our timetable. Changes do not affect orders already confirmed before the change.
6. Order Placement and Confirmation Process
- Step 1: You choose a coach, a service or pack, and a time on the Website.
- Step 2: You give your contact details, choose how you will pay, and confirm the order.
- Step 3: We email you a confirmation with your order number, the amount due and when it is due.
- Step 4: For single sessions and performance screens, you pay at the front desk. For packs, memberships, online coaching packages and gear, the order is confirmed once online payment succeeds. For courses, group classes and workshops, the order is confirmed once we have received payment.
An order exists only once you have received our confirmation email. If you have paid and no confirmation arrives within 30 minutes, call our hotline so we can trace it — please do not pay a second time.
7. Pricing, Taxes, and Invoicing
Prices are shown in Vietnamese Dong before value added tax (VAT). VAT is added at the rate in force under Vietnamese law on the date of payment for the type of product or service bought. Before you pay, checkout shows the price, the VAT rate, the VAT amount and the total as separate lines. If the VAT rate changes, the new rate applies to orders paid from the date the change takes effect; orders already paid are not affected.
Gear prices do not include delivery; delivery is calculated and shown at checkout before you confirm your order. Apart from VAT, coaching prices are the full amount payable to TGA. Any range or parking fee at a third-party venue is charged by that venue, not by TGA.
We issue an electronic VAT invoice on request. Give us your invoicing details when you order, or email us within 7 days of paying.
8. Payment Terms
Payment methods, payment timing and the handling of payment data are set out in our Payment Policy, which forms part of these Terms.
9. Validity Period, Retention, and Transferability
A pack's validity runs from your first session, not from the day you pay, and ends on the date shown on your order.
You may freeze a pack if you are injured or unwell and can show medical paperwork, for the length of the treatment prescribed. If you are away for work, a pack may be frozen for up to 30 days. A freeze request must be emailed before the pack expires. We do not extend a pack after it has expired.
Sessions are personal to you. They cannot be resold, transferred to another person, or moved to a coach at a lower rate than the one you paid.
10. Cancellation, Returns, and Refunds
Cancelling or rescheduling sessions, cancelling packs, memberships, courses, online coaching packages and places in group classes and workshops, returning gear, and obtaining refunds are governed by our Cancellations, Returns and Refunds Policy, which forms part of these Terms.
11. Health, Safety, and Customer Representations
Fitness training is demanding physical exercise. Before you start, you must tell your coach about injuries, pain, pregnancy, heart or respiratory conditions, and any medical advice you have been given.
TGA provides movement and fitness coaching. We do not diagnose or treat medical conditions and we are not a substitute for professional medical advice.
You must follow the studio rules and your coach's technical instructions, and stop an exercise if you feel pain or anything unusual. You sign a health waiver before your first session.
12. Intellectual Property Rights
Everything on the Website — our coaching method, movement tests, programmes, materials, images, video, software, interface, trademarks and logos — belongs to TGA or to our licensors, and is protected under Vietnamese law and international treaties.
You may use the programme we build for you for your own training. You may not copy, distribute, resell, commercialise or use our content to coach third parties without our prior written consent.
13. Customer Content and Media
We use a customer's photos, video, training results or testimonial in our marketing only with that customer's prior written or messaged consent.
You may withdraw consent at any time by email, and we will remove the content from the channels we control within a reasonable time.
For anyone under 18, a parent or guardian must give that consent.
14. Personal Data Protection
How we collect, use, store and share your personal data is set out in our Privacy Policy, which forms part of these Terms.
15. Third-Party Content and Links
The Website may link to third-party sites and services, such as social platforms, our payment provider and couriers. We do not control and are not responsible for their content, policies or practices.
Your use of a third-party service is governed by that third party's own terms and policies.
16. Limitation of Liability
We are responsible for delivering the service as described and in line with Vietnamese consumer protection law.
To the extent the law allows, we are not liable for: injury arising from a customer failing to disclose their health accurately or failing to follow a coach's instructions; indirect, incidental or consequential loss; or failures caused by third parties, including interruptions to payment, delivery or technical infrastructure.
Nothing in this section excludes liability that the law does not permit us to exclude.
17. Indemnification
You agree to indemnify TGA for loss and reasonable costs arising from your breach of these Terms, your breach of the law, or your misuse of our services or content.
18. Suspension and Termination of Services
We may refuse service, suspend it or end it where: your conduct puts you, another customer or our staff at risk; you seriously breach the studio rules; or you have given us false information.
Where we end the service and you are not at fault, we refund the unused balance under our Refunds Policy.
19. Force Majeure
We are not liable for delay or failure caused by events beyond our control, including natural disaster, epidemic, fire, power failure, telecoms outage, or a decision of a competent authority.
In those cases we will tell you, and we will rebook your sessions or refund the unused balance.
20. Complaints and Dispute Resolution

We confirm receipt within 24 working hours and answer within 7 working days.
We will try to resolve any dispute by discussion first. If we cannot agree, the dispute goes to a competent court in Vietnam and Vietnamese law applies.
21. Amendments to Terms
We may amend these Terms. The updated version is published on the Website with its update date and takes effect when published.
Orders confirmed before a change continue under the version of the Terms in force when the order was placed.
22. General Provisions
If any provision is held invalid, the remaining provisions stay in force.
These Terms, together with the Payment Policy, the Cancellations and Refunds Policy, the Delivery Policy and the Privacy Policy, form the entire agreement between you and TGA.
Where the Vietnamese version and a translation differ, the Vietnamese version prevails.
